California Parents Seek Joiners to Class Action to Obtain Justice, Remedies for Alleged Family Court Corruption and Fraud; Challenges Gavin Newsom's Appointment of Stigmatized Judge Daniel Segura's as Unfit and Abusive to the Public Trust
SAN DIEGO, Oct. 25, 2024 /PRNewswire-PRWeb/ -- A class-action allegation by Citizen of California has sparked unprecedented legal battle including allegations that Governor Gavin Newsom has 'intentional' participation to disenfranchise Californians by 'knowingly' appointing significantly 'stigmatized' judicial officers that are behaving as "Political Weapons" of the state and seemingly 'unfit' and abusive to the Public Trust. A San Diego County-based father, author and Marine Vet. Marian Anthony is fed-up, and has organized parent litigants and started a public petition, as he leads this Class Action in a Federal Civil Rights suit against the State and claims that 'breaching the public trust' is not protected by 'Absolute Immunity Authority' and that thousands of similarly situated litigants, with a common cause have a right to be heard. Anthony is encouraging citizens who have been 'victims of the family courts' to step forward and be heard so that justice may be served.
Anthony and his class action of litigants believes the State is 'knowingly' installing unqualified and 'unfit' judges [commissioners] into family court as their 'training grounds' to experiment on the unwilling as guinea pigs for new lawyers and judges to cut their teeth. This is contrary to the 'best interest of the children' standard that significantly underscores the prejudicial abuse of discretion that is plaquing the family court system today.
Anthony believes that the state is self-perpetuating a multi-generation re-supply of broken families to justify the expansion of the corrupt judiciary by forcing parents to remain silent while the state participates in what Anthony alleges as 'human trafficking' by state agencies.
Anthony believes his case among others is a perfect example of the State's 'Abuse of Process' by severely harming families from what on the surface appears to be 'non-crime issues' like in Anthony's case; he was found by Segura of 'disturbing the peace' while entering his own home with his children while they were in his custody that weekend. Anthony believes that he and the children have the highest priority to enter their home and had an unrestricted right of reasonable expectation of privacy and security inside the home that Anthony owned, and settled with his ex-wife by means of a "buy-out" in a PSA, a Property Settlement Agreement. Anthony said that Segura sided with his ex-wife Corina Galvez because she made false reports to police, and later in her testimony admitted to making false allegations to police that led to Anthony's detainment and $210,000 bail, yet Segura 'knowingly' used the 'false arrest' pretense as a means to establish a Domestic Violence Restraining Order against Anthony, not permitting him to have custody of this two children for two-years.
Anthony and Galvez were subject to a PSA, a Property Settlement Agreements. In California a PSA is non-modifiable when in final form and once they have past the 'reservation' statute. Anthony claims that his case is a model of 'state overreach' and 'abuse of process' like with many others, the joiners are similarly situated in the class action from the state to 'wrongfully' interfere in equitable contracts after the divorces were final.
Anthony claims "The State is after everything you own in exchange of the hamster-wheel of endless litigation that encourages hostility, damages the children, resolves little and exceeds the bounds of reason." Anthony and the joiners believe that the State of California is promoting a 'weaponization oft he judiciary' just like they did to President Donald Trump to 'intentionally' disenfranchise the citizen of their right to parent without any 'fitness' findings which violates the 14th Amendment of Due Process.
Anthony and the Joiners believe that the parents must be heard, and that the Achillies heel of the judiciary is public loss of trust in the judiciary and urge others to step forward to compel a change in legislature with the doctrine of 'Vox Populie, Vox Dei' the Voice of the People is Sacred.
